 Terms &
ConditionsAll TotalAd's Members are required to read and agree to the
following Terms and Conditions. Anyone found in deliberate violation or seriously
disregarding these terms and conditions will be permanently excluded from the TotalAd
Network.
Terms:
- As a Totalad Member, you will agree to place a TotalAd Member's banner on your site.
- The TotalAd service reserves the right NOT to accept any new member who does not fully
comply with our rules and requirements.
- We do not allow any foul language, racism, pornography or other offensive material, or
any illegal activity such as software pirating, hacking or illegal MP3 files etc.
whatsoever to be displayed through TotalAd. Sites containing such material, activities,
and/or sites with links to such sites and/or sites encouraging illegal activity, will not
be accepted.
- We are not responsible for any damage or loss of information that might result from the
use of the TotalAd service.
- We are not responsible for any personally offending banner that you may encounter on
your site, or other sites.
- TotalAd cannot guarantee complete accuracy or dependability but we will do our best to
provide you with a high quality service at all times.
- The TotalAd name, information, database, reports, site, software and logo ARE NOT to be
copied or used without explicit written permission from TotalAd. Violation of our
copyright of ownership to the above mentioned items is considered a criminal act, and will
be examined and determined in a court of law if deemed necessary.
- The information provided by the TotalAd service to its members may be proprietary in
nature. Members acknowledge that they are not competitors of ANY TotalAd services, and
agree not to share this information with any competitors.
Banner Rules
- You will place the HTML code we provide at the top or middle of the first screen of your
page so that it is viewable without scrolling down. This optimum position will also
increase your click rates.
- We will provide you with an HTML code to be placed on your site. Do not make any
adjustments or changes within this code, otherwise you might damage your account's
statistics. We cannot be held responsible for any consequent problems caused by careless
alterations on your part. Before making any changes to the HTML code, please consult with
us.
- The Site-Host member may place multiple Totalad HTML codes in each page of their web
site. But it is not allowed to place multiple banners in the same page.
- Site-Hosts who abuse ("cheat") TotalAd with the use of any technique or
automatic devices to gain more clicks will be permanently exluded with loss of any accrued
banner credits.
- The TotalAd banner may not be placed on pages that contain no content.
- Banner Statements. Making statements near the TotalAd banner requesting that your
visitors "click" on the banner is not allowed. Site-Host sites may only use one
of the following terms verbatim:
a) Click here to visit our sponsor
b) Please support our sponsor
c) To visit our sponsor, click here
d) Please visit our advertiser
- Any person, company, or group may have only one account. Each account however may cover
multiple domains and websites. All activity will be consolidated into one report.
- Spam is not allowed at TotalAd. You may not use unsolicited e-mail or inappropriate
newsgroup postings to promote your website. You may not encourage others to click on our
advertiser's banners in any way including e-mail, newsgroup postings, and chat sites.
- Banner Credits are based on one "unique visitor" click through to another
Member's Web site within a 8 hour period.
- No Banner Credits will be grante if TotalAd detects that any referral has been
fraudulent.
Termination
- We reserve the right to cancel a Member's status at any time effective immediately upon
sending an electronic message to the e-mail address provided in the initial application.
We also reserve the right to alter these Terms and Conditions at any time without notice,
by email to all Members.
- This contract shall be automatically renewed for successive periods or may be cancelled
immediately by either party at any time by notification in writing via e-mail.
We have developed the most highly advanced anti-fraud software to
date. If you are applying to join our network with the intent to fraudulently generate
click throughs, please be advised that our software will report this activity to us.
Fraudulent activity may result in cancellation of any accrued Banner Credits, removal from
the Network, and legal action.
The TotalAd Network reserves the right to modify this agreement at
any time as mentioned above !
